The answer is in your question. Numbers. A few years ago (circa 2002-) no one complained much about Indians. Recently the complaints in the media/forums etc. are much higher. Why ? More H1, => more bodyshoppers (mainly India) => more abuse => more complaints and so on.

Also FYI, H1 is "temporary" just like F1. H1 is not a guarantee to GC. So you need to go back after 6 years, since you say F1 should leave after graduation.



Thats my point. Why are pakistanis getting green cards and nobody is saying they have taken jobs away from Americans? So many come to US on visa free travel, work 6 months undocumented from european countries, yet they are the first to get the GCs while Indians abuse B1, they abuse H1. How come only Indians abuse everything no one else abuses anything?

Gurus,

I have a unique position. couple of weeks back I was told that have fatal cancer and won't live pass 4-6 months. After recovering from initial shock I am wondering if my wife will be able to continue her american dream or she will have to head home after me.

I have filed 485 with approved 140 back in june, 2007 with PD of March, 2003

So is it a problem if you try to go for landing AFTER you apply for AOS?
What about those who landed before they filed i-485?

I google'ed and came across not-so-good information about this.

Mr are u going mad because ur wife didn't get H1. see I too have worked with F500 & F200 companies don't think that ur wife is better then all. My consultant told me that he has a job for me but because for this market companies have freesed there recruitments. So don't get pissed and good luck for ur wiefe's visa this year.

I don't know the solution to your problem. But I do know that there is a default spell checker when posting message. It highlights misspelled words that you can then right click & correct.

Good post. One question to you. Would you be able to give 7 days of your vacation early next year? I want to device a strategy for success. If you are interested we will work togther. And whatever strategy is formed, it will have blessing of IV and participating member. Please reply for this post. Be serious. I am not joking.

Not only you I need around 100 peoples one weeks time. So other people serious about getting GC, if you are willing to part away your valuable one week time that would be great.

I would like to stress, I am not dying because of GC. But I think we need to do something to get GC. Otherwise, we will be in QUE, a lonnnngggg QUE.

First and foremost we have to realize that we are fee paying customers to USCIS. We have a right to demand better customer service. The reports and other kind of data they are releasing currently is an insult to the high skilled immigrant community. It is time we call out that the king (USCIS) has no clothes. They have been feeding us garbage disguised as reports and offical data. Anybody with a high school degree would say that the reports and data provided have zero value since they are not complete.

How do we get the right kind of information from USCIS?
Here are the steps

a) Send letters to the Dept chief asking for the data we need and wait for 3-4 weeks for a response. ( Data we should ask for, apps pending with PD's and EB category for every month starting from 1998)
b) Send another letter to the President and copy USCIS chief on that. Wait for another 3-4 weeks
c) If we do not get any satisfactory information after the previous 2 steps and 2 months of waiting, we should do a relay protest in DC and in front of all the USCIS centers until they provide us with the exact data.

By doing this we woould have put enough spotlight on USCIS and also our problmes would have got enough coverage in the media. From here we can try and work with the various agencies to push for our other agendas. Now we will have a clearer picture of what the situation is and ask for the right things. At the same time the agencies will have the better information with them to look in to our issues.

I agree.. the amount of fees paid to USCIS keeps on increasing every year and the customer service degrades proportionally every year.. they need to understand that they are there for US(the legal immigrant community).. we have to make USCIS's proceedings more transparent and make them more accountable.. whats happenening with EB2-I can very well happen with EB-3 in the future...once they become current....

This is my understanding. Please take time to read INA, I485 application and current VB.

1. The category of the derivative and quota of derivative is not related to I485.

All that matter at the time of derivative I485 application is the
a) primary's priority date is current
b) primary's I485/AOS application pending.

read the I485 application again Part2 option b. "My spouse or parent applied for adjustment of status or"

Gurus, Forum-Attorneys, IV-Core, feel free to correct me.

2. We are more concerned about the quota. where the derivative falls. I strongly believe they must be out of EB2 quota and placed under FB2A.


There may be a chance that Eb2 india will touch 2008 in a year. and F2b will be at 2006. How dependet can file 485 as if they counted against F2A their date is not current.
